BERNABÉU MARKET'S “LA PEÑA” LOYALTY PROGRAMME LEGAL BASES

  1. Organising entity

The entity responsible for the “La Peña” loyalty programme is RESTÁNIMA S.L. residing at Calle José Abascal, 59, 28003, and VAT number B70206313.

  1. Purpose of the programme

The aim of the “La Peña” loyalty programme is to reward the loyalty of Bernabéu Market customers through the accumulation of points called “marketitos”.”, which may give access to discounts on future purchases, in accordance with the terms established in these terms and conditions.

  1. Territorial and personal scope

The programme will be valid exclusively for consumption at Bernabéu Market and participation is open to natural persons over 18 years of age who correctly adhere to the “La Peña” programme.

  1. Accession to the programme

Membership of the “La Peña” programme is free of charge.

On joining the programme, the customer will automatically receive an initial balance of 30 welcome marketits.

Joining the programme implies full acceptance of these legal bases.

  1. Marketitos accumulation system

Customers participating in the programme will accumulate marketitos according to the following rule:

  • 1 euro (€1) consumption = 1 marketito.

The marketites will be allocated on the amount actually paid by the customer for each consumption, according to the terms determined by Bernabéu Market.

Bernabéu Market may not allocate marketitos in respect of amounts refunded, cancelled or corresponding to fraudulent or irregular transactions.

  1. Obtaining the discount

When the customer reaches a minimum balance of 300 marketitos, will get the right to exchange them for a 10% discount on a single subsequent consumption.

The discount:
(a) may only apply only once per consumption;
(b) consist of a 10% discount on the consumption amount in which it is exchanged;
(c) shall not be exchangeable for cash or any other financial compensation.

 

  1. Exchange conditions

Redemption of the discount is subject to the following conditions:

  1. When the customer reaches a balance of 300 Marketitos, the right to a 10% discount will be automatically generated, which must be applied to the next consumption made by the customer in Bernabéu Market.
  2. Once the 300 marketitos have been reached, they will automatically be considered for redemption and the customer will not be able to continue accumulating them or reserve their use for subsequent consumption until the discount has been applied.
  3. The 10% discount can only be applied once per consumption.
  4. Under no circumstances may several discounts from the programme be applied to the same consumption for exceeding multiples of 300 Marketitos.
  5. The promotions and discounts derived from the “La Peña” programme cannot be combined with other promotions, offers, discounts or campaigns in force, unless Bernabéu Market expressly states otherwise.
  6. The discount must be applied at the time of payment of the next eligible consumption, and cannot be applied after the closure of the ticket.
  7. Once the discount has been applied, the 300 marketits corresponding to the redemption will be deducted from the customer's balance.
  1. Nature of marketing

Marketitos are promotional, personal and non-transferable. They do not constitute a means of payment, have no monetary value outside the programme and may not be sold, transferred or exchanged.

  1. Discharge, suspension or misuse

Bernabéu Market may terminate any participant or cancel accumulated marketitos in case of fraud, abuse, misuse of the programme, non-compliance with these terms and conditions or use contrary to good faith.

  1. Modification, suspension or cancellation of the programme

Bernabéu Market reserves the right to modify, suspend or cancel the “La Peña” programme for justified reasons, and undertakes to communicate this to the participants with reasonable notice by the means it deems appropriate.

The amendments will not affect rights already created by consumers contrary to the requirements of good faith. 

  1. Protection of personal data

In accordance with data protection regulations, the organising entity informs that it will proceed to process the personal data provided by users, in the following terms:

Purposes: The data will be processed for the purpose of managing the participation of customers in the loyalty programme, including registration in the programme, the allocation and management of points or benefits (marketitos), the communication of advantages associated with it, attending to their queries or incidents and compliance with legal obligations.  

Legitimacy of the processing: The legitimacy for the processing of the personal data provided is based on the consent given by the data subject, on an individual basis when joining the loyalty programme.

BERNABEU MARKET will not carry out any processing of images of the winners or accompanying persons or use their image for commercial or promotional purposes in its media or social networks without their consent.

Communication of data: The data collected may be provided to other companies/agencies related to the management of the services provided by the entity (for the execution, administrative and/or accounting management of the promotion, Tax Agency, etc.) or auxiliary to them, as well as in the cases provided for by law.

Retention periods: Personal data will be kept for as long as your opposition to the processing is not exercised and within the legally established periods. the personal data blocked will only remain at the disposal of the Public Administrations, Judges and Courts, for the attention of possible liabilities arising from the processing, during the period of prescription of these. Once the aforementioned period has expired, the data shall be deleted.

Rights: Participants are informed of the possibility of exercising their rights of access, rectification, cancellation, opposition, limitation and portability to the processing of their personal data by means of a written request addressed to: derechosrgpd@bernabeumarket.com. In addition, on social networks you may exercise the rights conferred by law, although, since these platforms belong to third parties, the responses to the exercise of rights will be limited by the functionalities allowed by the social network in question, so we recommend that before following our profiles on social networks you review the conditions of use and privacy policies of the same. If you consider that your treatment does not comply with the regulations in force, you may lodge a complaint with the supervisory authority at aepd.es

  1. Acceptance of the rules

Participation in the “La Peña” programme implies full acceptance of these terms and conditions.

  1. Applicable law and jurisdiction

These terms and conditions shall be governed by Spanish law. For any dispute that may arise from the interpretation or application of these rules, the courts and tribunals that correspond in accordance with consumer and user regulations shall have jurisdiction.
